TERMS AND CONDITION

Please read these carefully, by booking a session with Ada Okekeogbu Photography you are agreeing to our terms and conditions

DEPOSIT

a) A deposit of £99 is required at time of booking to secure your session. An invoice will be sent to your email containing a link to pay, please note that till deposit is paid, there is NO confirmation of session.

b) Deposits taken for sessions are non refundable but are transferable within availability if given at least 72 hours notice. Consideration might be considered in exceptional circumstances.

IMAGE SELECTION /DIGITAL ORDERS

a). Images will be backed up on external hard drives for a minimum of 6 months after purchase. Ada Okekeogbu Photography cannot be held responsible in the case of total catastrophic failure of files and it is your responsibility to ensure purchased digital files are backed up on your own devices.

b). All orders are non refundable once placed due to the nature of the products.

c). Images are delivered via digital download or via USB and isn't intended as permanent storage. It is solely Client's responsibility to back up the images and make enough copies for the images to be stored safely. Ada Okekeogbu Photography cannot be held responsible for loss of images due to failure to download or back up images.

d) Ada Okekeogbu photography cannot be held responsible for client printing their own images, cannot be held liable for images looking a different colour, crop etc.

FULFILMENT OF OBLIGATIONS

a) Ada Okekeogbu Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. In the unlikely event of total photographic failure or cancellation of the contract by Ada Okekeogbu Photography liability shall be limited to a full refund of all monies paid.

b) The Client understands and accepts that the photographic coverage will be as Ada Okekekogbu Photography's professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.

c) If Client fails to read the supplied messaged with preparatory information, and therefore fails to carry out required preparations prior to a session, Ada Okekeogbu Photography will not be held responsible for any resulting reductions in quality or quantity of images supplied.Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.

d). In the event of an unsettled baby, some requested props or poses may not be suitable, Ada Okekeogbu Photography will use alternative props or poses. Please note, not all poses and shots are guaranteed. 

e). Ada Okekeogbu Photography will end the session at her discretion when it is determined that adequate images in terms of quality and quantity have been captured. There will be no refund or credit for unused time.

f). Images will be delivered within 3-4 weeks depending on how busy we are at a time, products will take longer as our products are ordered all other Europe and sometimes shipping takes longer, Ada Okekeogbu will not be responsible if product take longer than expected.

ARTISTIC INPUT

a). By booking a photoshoot with Ada Okekeogbu Photography you agree to allow full artistic licence to Ada Okekeogbu. You are also acknowledging the style and colours used and agree to let photographerto choose the colours based on personal preference.

a). Ada Okekeogbu Photography shall be entitled to use its judgement regarding the style and artistic input in the production of images. This includes but is not limited to poses, props and number of images taken. Due to the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations.

b). In the event of uncooperative children at a session of any kind, for any reason, Ada Okekeogbu Photography may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

c). Newborn images are fully edited before presenting to Client. Images from other session will be soft proofed and sent to client, to choose which ones they will like edited. Please note that this needs to be chosen within time frame stated in the email. Failure to do so before gallery expires might incur additional charges.

d). Retouching includes clearing skin, getting rid of flyaways and single strands of hair in the face and obvious blemishes. Retouching does not include things like physically changing body shapes, fitting dresses, removing people or things from a photo, fixing clothes/makeup etc or adding things to images. Requests for non standard editing may incur a fee.

COPYRIGHT AND REPRODUCTION

a). Ada Okekeogbu Photography is the rightful copyright owner of the digital images taken during your sessions. Ada Okekeogbu Photography authorises the Client the right to reproduce the images and make an unlimited number of prints for PERSONAL USE ONLY. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the original files releases Ada Okekeogbu Photography from any liability due to loss or damage of the images, and also releases Ada Okekeogbu Photography from any obligation to maintain copies of any digital file, image, or photographs.

b). Client may not alter, add to or manipulate an image by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture.

c). All images produced by Ada Okekeogbu Photography are done on a fully calibrated monitor, and all prints will be a true reflection of the editing carried out by me. Ada Okekeogbu Photography will not be held responsible for variances in images caused by clients viewing images on non calibrated screen, monitor and electronic devices where colour calibration and brightness has not been calibrated. Ada Okekeogbu Photography is not responsible for the print quality of other print labs the Clients use.

d). Please note that Ada Okekeogbu Photography under no circumstances give raw/ unedited images to a client.

e). Please note that it is illegal to attempt to download, copy, snap shoot, save, scan, screenshot and remove a watermark from any images from the Client's gallery or any image taken and posted online by Ada Okekeogbu Photography for any reason. 

PRICE OF PRODUCTS

a) Our price list is accessible to the general public on the website. Ada Okekeogbu Photography cannot be responsible for Client's failure to read price list prior to the session.

b) Pricing of products is subject to change at any time without notice.

CANCELLING THE SESSION

In the event of an illness or misadventure, please call as soon as possible to reschedule. Ada Okekeogbu Photography maintains the right to reschedule at any time should it become necessary but will do her upmost to negotiate a mutual acceptable rebooking. The request must be made no later than 72 hours prior to the start of the photography session. 

If the Photographer has to cancel the appointment due to illness an alternative date will be offered where possible. Where not possible, the photographers liability shall be limited to a full refund of the session fee.

For cake smash sessions where the Photographer has commissioned a custom cake, a fee of £40 will be charged towards a new cake if the session can not be moved to the next day or day after because of prior bookings or the child remains ill.

USE OF IMAGES

a). Ada Okekeogbu Photography reserves the Right to use images created under this contract for use on Websites, for advertising, display, trade, promotions, Publication, competitions and other Lawful purposes including on social media. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all purposes included in the portraits in this manner and shall indemnify and defend Ada Okekeogbu photography in the event of litigation arising out. 

PHOTOGRAPHY AND VIDEOGRAPHY BY CLIENT

a). No camera phone or any recording devices are allowed in the studio during the session. Ada Okekeogbu Photography will ask for permission before doing a behind the scene recording of you or your little one for social media.

RETURNS & EXCHANGES

a). Ada Okekeogbu Photography is unable to give exchanges or refunds. All portraits, prints, canvases, frames, etc. are non-refundable, orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Ada Okekeogbu Photography you are committing to buy the ordered products. This does not affect your statutory rights.

Once you have purchased digital files you are granted a personal licence to use your images for your own individual use ONLY. These images are not to be sold or given to any third parties without prior written consent. 

HEALTH AND SAFETY 

a). For cakesmashes, Ada Okekeogbu photography includes a professionally made custom cake with all of her cake smash packages. Client is welcome to bring their own cake and will need to notify the Photographer 2 weeks before the photoshoot date, however no refunds or credits will be given for providing your own.  

b). Ada Okekeogbu photography cannot be held liable in the event that a child/children is found to be allergic to any of the ingredients used to make the cake and it is strongly recommended that you ensure your child does not have any allergies to any component of the cake (eggs, flour, baking powder, baking soda, salt, butter, vanilla extract, lime juice and other diary products)prior to the session. The cake will be provided by HOMEBAKE AGNIESZKA KUPCZAK or JASMINE CAKES. They are fully registered with the Local food authorities and complies with the council standard.

IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE UNDER THE LAW, THE VALIDITY OF THIS AGREEMENT AS A WHOLE SHALL NOT BE AFFECTED AND THE OTHER PROVISIONS OF THE AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.

By paying your invoice you agree you have read, understood and agree with all the T&C as above.
